Hayward is an East Bay pickup and delivery market with a jurisdiction twist: two of the three licensed stores on this page are not in the city. Cookies at 1004 B Street is licensed under City of Hayward jurisdiction, and Tri City Voice reported on 30 Dec 2025 that the city is allowing three dispensaries. Garden of Eden on Foothill Boulevard and We Are Hemp on East Lewelling Boulevard have Hayward mailing addresses but sit in unincorporated Cherryland and Ashland, under Alameda County jurisdiction.

As of 23 Sep 2026, all three hold active licenses from the California Department of Cannabis Control (DCC). The city is not accepting applications for new storefronts, according to its permit page updated on 9 Jun 2026. Alameda County's ordinance code (section 6.108.030) caps cannabis retail permits in the unincorporated county at five, and as of 16 Oct 2026 DCC lists three active retailers under county jurisdiction: We Are Hemp and Garden of Eden, both in what a 2021 county staff report calls Area 1 (Ashland and Cherryland), and Highlands Dispensary at 7000 Tesla Road, which has a Livermore address but sits outside the city limits.

This page is for the visitor arriving by BART or flying into OAK, and for locals comparing licensed stores. The short version: buy from a licensed counter, use it on private property where the owner allows it, and leave it in California.

How buying works here

  1. 01Age and ID: Adult-use sales are for customers 21 and older with a valid government photo ID. Customers 18 to 20 can buy only medicinal cannabis, with a physician's recommendation.
  2. 02Purchase and possession limit: State law lets adults 21 and older buy or possess up to 28.5 grams of non-concentrated cannabis and 8 grams of concentrated cannabis.
  3. 03Check the license: Every licensed retailer must post its state license in the window. Scan the QR code on the certificate to confirm the store with DCC.
  4. 04Delivery: Garden of Eden offers same-day delivery from its Foothill Boulevard store when you order by 7pm, per the operator.
  5. 05Paying: Garden of Eden takes cash and debit at the counter and has an ATM on site, per the operator. Ask other stores before you go.
  6. 06Driving home: An open container of cannabis in a moving vehicle is illegal in California. Keep purchases in a sealed package or in the trunk.

How do you get to Hayward's dispensaries by BART, bus or car?

Take BART to Hayward station for the downtown store, and drive or take a bus to the Foothill and Lewelling stores. Hayward BART at 699 B Street and South Hayward BART at 28601 Dixon Street are both served by the Richmond to Berryessa/North San Jose line and the Berryessa/North San Jose to Daly City line.

AC Transit's line pages list Hayward BART on local Lines 9, 28, 34, 41, 56, 60, 86, 93 and 95 and All Nighter Line 801. Lines 10 and 99, still shown on BART's station-area map of 5 Dec 2022, are no longer active, so check AC Transit before you ride.

Hayward BART sells daily-fee and reserved parking through the BART Official app. Downtown, the city's 13 lots and two garages are free with posted time limits. On Foothill Boulevard, Garden of Eden says curb parking is off limits during the 7 to 9am and 4 to 6pm commute windows.

How did Hayward grow from a rancho into an East Bay city?

Hayward grew from a Mexican land grant, a roadside store and a hotel. In 1843 the Mexican government granted Guillermo Castro almost 27,000 acres, which he named Rancho San Lorenzo, and in 1852 a failed gold prospector named William Hayward opened a general store at A Street and Mission Boulevard.

The town incorporated on 11 Mar 1876 as Haywards, after the landmark hotel, and later dropped the s. The Hayward Fault had already ruptured on 21 Oct 1868 in a magnitude 7.0 earthquake that damaged or destroyed nearly every building in the area.

Orchards and ranches followed. In the early 20th century the area was known as the Heart of the Garden of Eden for its climate and soil, and by 1950 it was the Apricot City, home to Hunt's Cannery. Between 1950 and 1960 the population grew fivefold, from 14,000 to 72,000. The city calls its Japanese garden on North Third Street California's oldest; it is open daily 8:30am to 4pm except Christmas Day.

What was Russell City, and why does Hayward still remember it?

Russell City was an unincorporated town west of Hayward where West Coast blues took hold after World War II. KTVU reports it had about 1,400 people and clubs where Big Mama Thornton, Ray Charles and Etta James played.

In 1964 Hayward incorporated the land, tore down the town and built an industrial park. The City of Hayward and the West Coast Blues Society started the Hayward-Russell City Blues Festival in 1999; the Mercury News reported its final edition in downtown Hayward in July 2019, after the organizer cited a lack of city seed money.

For the wider story, the Hayward Area Historical Society museum at 22380 Foothill Boulevard is open Thursday to Saturday, 11am to 3pm, with free parking behind the building off Russell Way.

Can you fly out of OAK with cannabis you bought in Hayward?

Plan to leave it in California. DCC says federal law bars taking cannabis across state lines, and the federal rule effective 28 Apr 2026 states that marijuana outside FDA-approved drugs and state medical licenses remains a schedule I controlled substance, so adult-use cannabis stays in Schedule I.

TSA's What Can I Bring page, last updated 27 Apr 2026, lists Medical Marijuana as "Yes (Special Instructions)" for carry-on and checked bags but prints no instructions. The same page says TSA officers do not search for illegal drugs, and that any illegal substance found during screening is referred to a law enforcement officer.

BART links Hayward and the airport. The Oakland Airport BART station is a short walk from both terminals, and riders arriving at OAK pay for the trip at Coliseum station, Platform 3. Garden of Eden is about 6.9 miles in a straight line from the airport's address at 1 Airport Drive.

Who licenses Hayward's dispensaries, the city or the county?

It depends on which side of the city line the store sits. As of 23 Sep 2026, DCC lists active retailer licenses under City of Hayward jurisdiction at 1004 B Street (Cookies Hayward), 22701 Foothill Boulevard (JIVA HWD LLC) and 21463 Foothill Boulevard (Gream Enterprises). Garden of Eden in Cherryland and We Are Hemp in Ashland are licensed under Alameda County jurisdiction.

Tri City Voice reported on 30 Dec 2025 that the approved Phenos store is 'one of three dispensaries Hayward is allowing in the city.' The city's permit page, updated 9 Jun 2026, says it is not accepting applications for new storefronts. In November 2016 voters approved Measure EE, which allows a general city tax of no more than 15 percent of gross receipts on cannabis business.

Alameda County's ordinance code (section 6.108.030) caps cannabis retail permits in the unincorporated county at five. As of 16 Oct 2026, DCC lists three active retailers under county jurisdiction: We Are Hemp and Garden of Eden, both in what a 1 Mar 2021 county staff report calls Area 1 (Ashland and Cherryland), and Highlands Dispensary at 7000 Tesla Road, which has a Livermore address but sits outside the city limits. The Board of Supervisors voted in December 2017 to let We Are Hemp and Garden of Eden, then medical dispensaries, seek adult-use sales, and a county committee decided on 2 May 2018 not to create a local cannabis business tax.

The city came later. A 2017 city FAQ said Hayward did not yet permit dispensaries, and on 9 May 2019 the Planning Commission approved a permit for a dispensary at 1004 B Street, the storefront that now trades as Cookies Hayward.

What should you know before your first visit?

Bring a valid government photo ID showing you are 21 or older, and look for the state license posted in the window. DCC requires it, and the QR code on the certificate checks the store's status. Our first dispensary visit guide walks through the counter step by step.

If you are trying edibles, DCC says they can take up to two hours to start working and up to four hours for full effect. Read the label first (see how to read a label and edibles basics), and keep products in a sealed child-resistant package, out of sight and reach of children and pets.

Most of Hayward's public spaces are off limits for use. California bans cannabis in public places, and the Hayward Area Recreation and Park District bans smoking, vaping and ingesting cannabis on all its property, parking lots included. Visiting from out of state? The tourist cannabis rules guide covers the basics.
